Warranty Policy
MAX BUILT TRAILERS LLC EXCLUSIVE LIMITED WARRANTY
Max Built Trailers LLC (“Max Built”) warrants that each Max Built Trailer operated by the original purchaser under normal use in the continental United States will be free from defects in materials and workmanship for the six (6) months following the original purchase date (“Warranty Period”), subject to the requirements, exclusions, and limitations stated below. The obligation of this warranty shall be limited to repairing or replacing any part or parts which, in the reasonable opinion of Max Built, is/are defective in materials or workmanship under normal use and service during the Warranty Period. If the trailer is rented, this Exclusive Limited Warranty is null and void.
YOU MUST REGISTER YOUR PURCHASE
In order to validate this Exclusive Limited Warranty, you must document your purchase. A registration card is attached to the bottom of the MSO (Manufacturers Statement of Origin) provided with each Max Built Trailer. Please complete the registration card and mail it to Max Built Trailers LLC, 2000 Smyrna Church Road, Chatsworth, Georgia 30705, no later than ten (10) days following the purchase of your Max Built Trailer. Failure to complete and return this warranty registration within the above period will automatically void this warranty.
SIX-MONTH LIMITED WARRANTY – STRUCTURE
Max Built warrants each Max Built Trailer against defects in materials and workmanship by Max Built for a period of six (6) months from the date of purchase, subject to the other terms of this Exclusive Limited Warranty. This Exclusive Limited Warranty and the remedies available hereunder are available only to the original retail purchaser. The structure covered by this Exclusive Limited Warranty is that portion of your Max Built Trailer fabricated by Max Built, which includes the main frame (the bottom rails and cross members) and the subframe (top rails, uprights, walls, and deck/floor). All components not manufactured by Max Built are excluded from this Six-Month Exclusive Limited Warranty, but may be subject to their original manufacturer’s warranty (see next section).
ONE-YEAR LIMITED WARRANTY – PARTS
Subject to the requirements, exclusions, and limitations stated herein, all other components of your Max Built Trailer are warranted by their respective manufacturers against any defect in the materials and workmanship arising from normal use for a period of one (1) year from the date of purchase. Such items are expressly excluded from this Exclusive Limited Warranty, as are any claims related to items that are warranted by their manufacturer. These items include, but are not limited to, tires, rims, axles, and axle components; brake components; springs and other suspension components; winches; couplers; jacks; hydraulic components (hydraulic cylinders, pumps, hoses, and fittings) and any other items manufactured by third parties and installed by Max Built. Any claims related to these items must be presented to their manufacturer. Subject to the other terms hereof, Max Built warrants its installation of the above-listed items such that any failure attributable to installation of the same by Max Built within the Warranty Period is subject to repair or replacement under this Exclusive Limited Warranty.
OTHER EXCLUSIONS
This Exclusive Limited Warranty covers only defects in original components which arise from normal use and does not apply if your Max Built Trailer has been subject to negligence, accident, abuse, misuse, improper loading, or other use conflicting with your Max Built Trailer’s Owner’s Manual, or has been repaired or altered without the prior written consent of Max Built. Any overloading in excess of the Gross Vehicle Weight Rating of your Max Built Trailer or other use conflicting with the Owner’s Manual shall void this Exclusive Limited Warranty. Damages caused by failure to provide proper maintenance and repair, loose, or improperly torqued lug nuts, use of incorrect or altered hitch ball or improper latching or loose nuts, bolts, and screws (maintaining necessary tightness is the owner’s responsibility) are not covered by this Exclusive Limited Warranty. In addition to the above exclusions, Max Built expressly excludes from this Exclusive Limited Warranty the following: tow vehicle wiring, replacement and work performed, or options installed by others; deterioration of paint and appearance due to use and exposure; loss of time; inconvenience; loss of use of trailer; rental of substitute equipment; loss of revenues; other commercial loss; and tow vehicle wear. The Max Built Trailer covered by this Exclusive Limited Warranty is designed to be towed by a vehicle with up to one (1) ton capacity. This Exclusive Limited Warranty does not cover any use of the trailer that exceeds the tow rating, gross vehicle weight rating, or other payload limitation established by the manufacturer of the tow vehicle.
PRIOR WRITTEN CONSENT AND RETURN OF DEFECTIVE PARTS REQUIRED
No reimbursement will be made to any dealer or owner for repairs made without the prior written consent of Max Built. Any defective parts must be sent by prepaid freight to Max Built at the address listed herein in order to qualify for replacement or reimbursement under this Exclusive Limited Warranty.
LIMITATION
MAX BUILT TRAILERS LLC’s RESPONSIBILITY UNDER THIS EXCLUSIVE LIMITED WARRANTY SHALL BE LIMITED TO REPAIR OR REPLACEMENT OF PARTS AT THE MAX BUILT FACTORY OR AT ANOTHER PLACE APPROVED IN WRITING BY MAX BUILT TRAILERS LLC. IF THIS WARRANTY FAILS BECAUSE ATTEMPTS AT REPAIR ARE NOT COMPLETED WITHIN A REASONABLE TIME, OR IF IT FAILS FOR ANY OTHER REASON, ANY DAMAGES ARE LIMITED TO THE LESSER OF EITHER THE COST OF NEEDED REPAIRS OR REDUCTION IN THE MARKET VALUE OF THE TRAILER CAUSED BY LACK OF REPAIRS.
DISCLAIMERS
THIS WARRANTY IS EXPRESSLY IN LIEU OF ANY OTHER WARRANTY NOT EXPRESSLY PROVIDED HEREIN WHICH BUT FOR THIS PROVISION MIGHT ARISE BY OPERATION OF LAW, INCLUDING ANY EXPRESS WARRANTIES OR OTHER REPRESENTATION MADE OUTSIDE THIS EXCLUSIVE LIMITED WARRANTY, THE IMPLIED WARRANTY OF MERCHANTABILITY, THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND ANY REMEDY FOR BREACH OF CONTRACT. THESE WARRANTIES ARE EXPRESSLY EXCLUDED AND DISCLAIMED BY THIS EXCLUSIVE LIMITED WARRANTY. IF SAID WARRANTIES CANNOT BE DISCLAIMED, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE ARE EXPRESSLY LIMITED TO A TERM OF SIX MONTHS UNLESS ANY APPLICABLE STATE LAW PROVIDES OTHERWISE. UNDER NO CIRCUMSTANCES SHALL MAX BUILT TRAILERS LLC BE LIABLE TO PURCHASER OR ANY OTHER PERSON FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER ARISING OUT OF BREACH OF WARRANTY, BREACH OF CONTRACT, TORT, OR OTHERWISE. UNLESS ANY STATE LAW PROVIDES OTHERWISE, NO ONE, INCLUDING AUTHORIZED MAX BUILT TRAILERS LLC DEALERS, IS AUTHORIZED TO MAKE FURTHER OR ADDITIONAL WARRANTIES ON BEHALF OF MAX BUILT TRAILERS LLC. AUTHORIZED REPAIRS DO NOT EXTEND OR END THE TERM OF THIS EXCLUSIVE LIMITED WARRANTY.
THIS WARRANTY IS NON-TRANSFERABLE FROM THE ORIGINAL OWNER
